UNIFORM CIVIL CODE.....

 

UNIFORM CIVIL CODE, ONE NATION ONE LAW, A REAL NEED OF AN HOUR IN INDIA WITH RESPECT TO MARRIAGE, ADOPTION, DIVORCE, MAINTENANCE AND SUCCESSION, WOMENS RIGHTS, GENDER DISCRIMATION AND SOCIAL ILLS IN THE SOCIETY.

 

Recently Government of India has initiated a debate on Uniform Civil Code.  There are voices raised for and against this Uniform Civil Code, some possess a moderate view and some are forcibly trying to give it a religious colour.  The current dispensation is already targeted by many as regards their so called extremist view.  Today the false propaganda has been at the front which has affected the very attempt of the Government of India to bring the unanimity amongst the people of India before introducing any legislation in the Supreme Houses of Democracy.  The matter is placed before all the intellectual class, civil society and the religious heads so that a common and comprehensive dialogue can bring the entire nation under one law.

 

India is a Secular country having huge population of different caste and creed which turns to be approximately 1.32 billions. Therefore it is but natural that in secular country like India, people belonging to various religious dominations have been conceded to the constitutional freedom to be governed by their respective personal laws with respect to certain sensitive matters like marriage, divorce, maintenance and succession. The policy of preserving personal law was so strictly adhered to, that the constitution proclaims in Article 372 that the law enforce in the country before the commencement of the constitution shall continue to remain in force until altered or repealed or amended by a competent legislature or any other competent authority.

 

In India each community has its own personal law.  Personal laws in India deal with marriage and divorce, maintenance, guardianship and succession, joint family and partition, and can broadly be characterized as ‘Family Law’. Since personal law deals with the relationship between private individuals, it is clear that personal law cannot be public.  Presently in India Hindu Law, Muslim Law, Christian Law and Parsi law are the broad personal laws.  Before going in to the details, it is necessary to have a look on Women Rights under different Personal Laws.

Women have been elevated to the level of divinity.  As per tradition, a woman has limited freedom.  She is dependent entity in a household dominated by male members.

Women have been recognized as legal entity and gave her all rights than man enjoyed. The status of women by instituting rights of property, ownership, inheritance, education, marriage and divorce.

Christianity emerged from Patriarchal societies that place men in position of authority in marriage, societies & government. They are working as religions sisters and nuns, played an important role in Church life also in schools, hospitals, nursing homes.

Parsi women are discriminated against by laws which have no basis in the communities religions belief. Parsi community having 90% literacy.

 All the codified and non-codified religions have been dominated and controlled by men, so all the tenets propounded in them push women to a subaltern status.  This can be delineated by examples from some important religions.

 

She is seen as merging her identity with her husband and the two are considered one entity, represented by husband.

She is equal to half a man for all legal and social purposes.

She is having low status, chose to view Eve and by extension women as source of evil and sin in the world.

She share the fear of extinction of community and most of them have resisted changes in their personal laws.

Hindu conception of marriage is totally divine and the marriage bond is unbreakable and even the death of the husband cannot free the wife of the bond of marriage.

While Young she remains under control of father, after marriage under the control of her husband and on his death under control of her sons.

Marriage (Nikah) is defined to be a contract which has for its object the procreation and the legalizing of children. The institution of marriage in Islam has three aspects, legal, social and religions.  Legally, it is a contract and not a sacrament. In India, marriages among all sets of Muslims are usually solemnized by Kazis or Mullas in presence of witnesses. The other things involved are Mehr, Polygamy.

The laws regulating to solemnization of marriage among Indian Christians is the Christian Marriage Act of 1872.

Three sets of authorities are provided for the solemnization of marriage, i.e. Minister of Religion, Marriage Registrars and Persons licensed to solemnize.  Registration of such marriage is compulsory.

The parsis in India are believed to be the descendent of Iranian Zoroastrians.  Parsi Personal law is based on Hindu Custom and the rules of English Law.  Marriage is required to be registered under Parsi Marriage and Divorce Act, 1936. Immediately on the solemnization, the marriage should be certified by officiating priest & witnesses.

 

In order to avoid the confusion amongst the people, a Special Marriage Act, 1954 was enacted which provides a special form of marriage which can be taken advantage of any person in India with some conditions relating to solemnization of special marriage.

Hindu Marriage Act, 1955 was enacted.  Divorce was introduced for protection of helpless women when they were ill-treated. 

Vital and dynamic changes in the Hindu Law of Marriage and Divorce were introduced in the Act, 1955.

Section 13, laid down clear provisions for divorce under certain circumstances.

Section 14 renderes the provision of divorce a bit difficult as no petition for divorce can be filed within one year of marriage except in exceptional hardship.

Section 15, lays down the limitations on the rights of divorced persons to re-marry.

Under Muslim Law, the husband has the unilateral power of pronouncing divorce on his wife without assigning any reason without an cause, literally at his whim, even in a jest or in a state of intoxication and without any resource to the court or any other judicial, administrative authority, even in her absence, by just uttering the formula of Talak.

It has been still in existence in Modern India. Under Digital progress of India, the Divorce under Muslim law has attained the highest humiliation to women as they are divorced on whatsapp and facebook like social medias.

The Indian Divorce Act amendment in 2001 deals with divorce among Christian.  Roman Catholics do not come under the purview of any divorce proceeding since their Church has not recognize Divorce.  It does not provided for divorce by mutual consent.

Since 1869, Indian Divorce Act did not undergo any major changes and thus Christian Law of divorce in India remained embedded on the principles of Victorian vintage for more than a century and a quarter.

The Parsi Marriage and Divorce Act, 1955 governs divorce for Parsis in India. 

If consummation of marriage is imposable because of natural cause, such marriage can be declared null and void at the instance of either party.

Their amendment Act, 1988 provides for divorce by mutual consent.  Divorcee women can claim maintenance for her spouse through criminal proceeding or/and civil proceeding.

Either party can present a petition for dissolution of marriage by a decree of divorce.

Under most of the Indian Personal Laws, there is a period of wait after a decree dissolving the marriage is passed, before the expiry of which spouses are not free to remarry.  The provision is identical in the Hindu Marriage Act, Special Marriage Act and the Parsi Marriage and Divorce Act.

Section 24 Hindu Marriage Act, 1955 deals with interim maintenance and expenses during proceedings.

Section 18 Hindu Adoption and Maintenance Act, 1956 defines maintenance as provision for food, clothing,  education and medical attendance and treatment.

Under Hindu Law the wife has an absolute right to claim maintenance from her husband.  A person has obligation to maintain his wife, children and aged parents.

Maintenance can also be claimed under section 125 Cr.P.C. and Protection of Women from Domestic Violence Act, Section 20.

The personal law statutes governing a Muslim woman’s right to maintenance are the Dissolution of Muslim Marriage Act, 1939 and the Muslim Women (Protection of right on Divorce) Act, 1986. 

The Muslim law of maintenance differs from the law of maintenance in most other system of law, except wife, in most of the cases the obligation of Muslim to maintain arise only if the claimant has no means or property out of which he or she can maintain herself or himself.

Maintenance is called Nafqah, it includes food, raiment, and lodging and other essential requirements for livelihood.

The Indian Christian have no Personal Law and their domestic obligations have to be governed by the English Law and under that law a wife has no common law right to suing her husband for maintenance.

In Indian Divorce Act, 1869 the right of only wife to maintenance, both alimony pendent lite and permanent.   Permanent alimony can be granted only in case of dissolution of marriage or judicial separation as per Section 37 of the Act.

The husband doesn’t have the same right under the said act, it can be claimed only by the wife.

Under Special Marriage act and Parsi Marriage and Dissolution Act the needy spouse, can apply for interim maintenance while under the Indian Divorce Act only wife can apply for interim maintenance.  The Parsi Marriage and Divorce Act, 1936 provide for maintenance Pendent lite and for permanent alimony and maintenance.

After the amendment the provision has been brought at par with the Hindu Marriage Act, 1955, now even a husband can seek maintenance.

Succession rights under different personal laws

The Hindu Succession Act, 1956 makes a new era in the history of social legislation in India.

Stridhan – Derived from Stri (Woman) and Dhana (property).

The Hindu Women Right to Property Act, 1937 was hailed as opening a fresh chapter in the history of woman’s right to property. This landmark legislation conferred ownership rights of women. It brings revolutionary changes in Coparceners and also in Law of Partition, alienation of property, inheritance and adoption.

Amendment of 2005, brings status of daughters equal to that of a son as coparcener.

The body of Islamic Law is referred to as Sharia or The Clear Path.  This emanates primarily from four sources.  The Quran, Sunna, Qiyas, and Ijma. 

The Muslim law of Succession and inheritance has been derived from Quaranic Verses. It is completely different from Hindu Law.  In Holy Quaran daughters are given rights of inheritance from their parents, wives from husband and mothers from their children.  It has changed the status of women in an unprecedented fashion.

The law of inheritance provides for fixed shares which take precedence over the succession of the next of kin to the residue.

Mothers get 1/3rd Share. Maternal Grandmother get 1/6th share. Widow get 1/4th Share.

Christian as a general law to the inheritance and succession are entitled to equal shares on inheriting the property on the death of a person.

The Indian Succession Act, 1925, states that everyone is entitled to equal inheritance, baring exceptions to Hindus, Sikh, Jains, Buddhists and Muslims as they are governed under separate laws of succession.

There is no discrimination between sons and daughters with regard to the distribution of the intestate father’s property.

The law for Christian does not make any distinction between relations, through the mother or father.  The relations from paternal and maternal sides are equally related to the intestate.

Like Hindus and unlike Muslim Law, there were separate rules for the distribution of the assets of a male and a female.  A parsi woman is accorded no protection against arbitrary decision either.  A parsi Male is not bounded by any such law.

The son is entitled to equal share of the mother’s property along with daughter.  The daughter is not entitled to the same right when she inherits the property of her father.  The son’s share in his father property is twice that of a daughter.

When a Parsi woman dies intestate, the property is divided equally among the widower and children. Male is not bound by any such restriction.

 

ADOPTION UNDER DIFFERENT PERSONAL LAWS

In view of the Dharmasastras, the adoption was looked mostly as sacramental law rather than a secular law.  In earlier days it was believed that only sons were capable of carrying forward the family lineage. During those days there was a strong belief that if a Hindu dies without having a song he would go to Hell.

After the codification of Hindu Law, a system is placed for the society under the Hindu Adoption and Maintenance Act, 1956 including the legitimacy and illegitimacy of the child.

The condition precedent of age difference of 21 years was incorporated to avoid the social evil.  The rights of the adopted son in the pre-adoption family and post adoption family were regularized.

The act has provided the requirements of valid adoption, eligibility both adoptive and adopted, capacity of a Hindu under the distinct provisions under the Hindu Adoption and Maintenance Act, 1956.

Under Muslim law, the process of child adoption has been a foreign subject… it is neither been accepted nor recognized.  In Islam there is a concept of Paternity.  Therefore adoption is forbidden in Islam. The Personal Law is silent on childless couple.  Even it there is a adoption then adopted children will have no property rights under Muslim Law.

The adoption is customary under Muslim Law, thererfore anybody desires to adopt a child has to first prove the existence of custom. Otherwise the Non-Hindus desirous of adopting a child can only take the child in guardianship i.e. The Guardian and Wards Act, 1890.

The judicial intervention at the Apex court has extended the right to adoption to Muslims. 

There is no legislation in existence to safeguard orphaned Muslim children. The right to adopt under Muslims is governed by Juvenile Justice Act as the Act will take precedence over all personal laws and religious rules in the country.

The personal laws under the Christianity do not recognize adoption.  The adoption can be taken place from an orphanage under the permission from the court of law under the provisions of Guardian and Wards Act.  The Christian has no adoption law. The adoption is a personal law issue as it is a legal affiliation of a child.

A Christian can only take a child into foster care under the act.

After the introduction of various amendments to the Juvenile Justice Act, 2002, the Christians can adopt a child under the act as it is having precedence over all the personal laws and religious rules in the country.

The different courts have taken diverse views relating to adoptions in the case of orphans, adoption from the original parents or biological parents or guardians.  But at present there is no legislation in existence as rescue to adoption in Christians.

Prior to the Act of 1956, Hindus were governed by Shastric and Customary laws which varied from religion to religion, and sometimes it varied in the same religion on the basis of caste.

A woman was humiliated, neglected in her own natal family as well as in the family she married into because of blatant disregard and unjustified violation of these provisions by some of the personal laws.

In the present scenario women as mothers, wives, daughters and widows do not have equal rights, while Quran gives equality to them.  The customary practices are highly discriminatory and it excluded daughters and widows in the bottom line of the succession order.

Women are kept in dark.  Most of her rights are confined within the pages of the rule book. Most of the women are not aware about their right under Islam and who are aware have never asked for it.

In Indian Succession Act, 1925, the right of Christian widow is not exclusive and gets curtailed as the other heirs step in.  Only if the intestate has left none who are of kindred to him, the whole of his property would belong to his widow. If there are any lineal decedent then only 1/3rd share devolves to his widow.

Another anomaly is that the widow of pre-deceased son gets no share, but children whether born or in the womb at the time of death would be entitled to equal share.

Parsi women were discriminated against by laws which have no basis in the community’s religious belief. Parsis having 90% literacy have among the most unjust inheritance laws in the country today. 

This finally only goes to prove the discrimination and gender biases do not disappear with progressive education.

 

 

In our Constitution of India, a woman is although awarded with the fundamental right of gender equality and right to life and liberty, ensuring dignified and equal status to that of a man.  But in actual practice they are observed more in breach than in compliance position.   In India, women professing any religion, Hindu, Muslim, Christian, Parsis etc., enjoy some rights which govern various aspects of their lives such as marriage, adoption, divorce, maintenance, inheritance, succession.  Her virtues, vices, strength, and her weakness are assumed on religions practices and religions norms. The evaluation of the status of women in India has been a continuous process of ups and downs since ages. 

 

Now a days the equality before law has been scrupulously asked and followed.  Recently India has seen various traditional changes while preaching and practicing the respective religious beliefs.  This is the indication of change.  Every Indian may it be woman or a man desires for change for their own empowerment.  The ironical situation is that Indians have placed the women on a very high pedestal and they are worshiped and honored as Goddess, but in practice we show no concern honor.  Despite of the 75 years of Independence the Women Reservation Bill is still under carpet and not seen the light of the day.

 

There is an inherent discrimination against women in the Indian social structure. This prejudice is widespread even among the educated and enlightened people. Education is the most powerful instrument for changing women’s position in society. Education for women lays an important role in women’s empowerment. Education boosts a women’s self-esteem, her self-confidence, her employment opportunities and her ability to deal with the problem of the world around. One cannot teach self confidence and self esteem; one must provide the conditions in which these can develop. Education helps girls and women’s to know their rights and to gain confidence to claim them. Education is important for everyone, but it is a critical area of empowerment for girls and women’s. This is not only because education is an entry point to opportunity but also because a woman’s educational achievements have positive ripple effect within the family and across generation.

 

Upon comparing the rights of the woman pertaining to Marriage, Adoption, Divorce, Maintenance, inheritance and succession amongst the above religion and religious beliefs, there is the disparity despite we the Indians being equal before the law as our Preamble prescribed.  In order to remove the anomaly amongst the women of different religious belief, it is very required to bring the common legislation for not only all the women but men across the religious belief in India and for that the Constitution of India specifically prescribes the Uniform Civil Code under Article 44, which is the need of an hour to place all the citizens on the same and equal platform. ONE NATION ONE LAW is the only prerequisite of Uniform Civil Code as prescribed under The Constitution of India.

विवाह संस्कार

 

विवाह संस्कार

हिंदू धर्मामध्ये सांगितलेल्या एकूण १६ संस्कारांपैकी पंधरावा संस्कार म्हणजे विवाह संस्कार.  १६ संस्कारात पहिला संस्कार गर्भधारणा आणि सोळावा संस्कार अंत्यसंस्कार प्रामुख्याने मनुष्यामध्ये असलेल्या सद्गुणांचा प्रभावी विकास आणि संवर्धन करण्यासाठी तसेच त्याच्यातल्या दोषांचे निराकरण करण्यासाठी हे १६ संस्कार महत्वाची भूमिका निभावतात. माणसाच्या सर्वांगीण तसेच व्यक्तिगत जीवनाला संस्कारित करण्यासाठी त्याच्या कल्याणासाठी ह्या संस्काराचे महत्व आहे. विवाह संस्कार नंतर सोळावा संस्कार म्हणजे थेट अंत्यसंस्कार, कारण विवाहानंतर सगळे संस्कार पुन:श्च गर्भधारणा संस्कारापासून सुरु होतात. बोलीभाषेत बोलायचे म्हटल्यास अंत्यसंस्कार हा एकमेव संस्कार आहे जो निवडीचा अधिकार मनुष्याला नाही परंतु इतर १५ संस्कार निवडण्याचे अधिकार प्रत्येकाला आहेत. 

आज जगात वायुवेगाने घटना घडत आहे, अख्खं जग अत्यंत वेगाने समोर जात आहे त्यात माणुसकी, प्रेम, भावना आणि संस्काराकडे थोडं दुर्लक्ष होऊन भौतिक सुखाकडे जग आकर्षित झाले आहे. एकीकडे हिंदू धर्मावर वाढते अत्याचार याच्या बातम्या पसरत आहेत तर दुसरीकडे भारताला हिंदू राष्ट्राकडे नेण्यास काही मंडळी सरसावली आहे.  आज २१ व्या शतकात विवाह संस्कारावर बोलणे म्हणजे एकवेळ हास्यास्पद वाटेल परंतु त्याची किती जास्त गरज आहे हे लेखाअंती प्रचीती येईल याची आशा आहे. असो.

सध्याच्या धकाधकीच्या काळात “मी आणि माझे” ह्यातच प्रत्येकजण गुरफटलेला आहे. “मी आणि माझे अधिकार” ह्या वर्तुळात प्रत्येकजण मग तो पुरुष असो अथवा स्त्री वावरताहेत. मग हळूहळू लग्नसंस्था मोडीत निघण्यासाठी हाच “मी” पणा कारणीभूत ठरत आहे. न्यायालयात घटस्फोटाची वाढलेली प्रकरणे पाहून आजकाल आश्चर्य वाटत नाही परंतु कीव करावीशी वाटते कि ह्या विवाहित जोडप्याला लग्न संस्था कळलीच नाही कि काय असे वाटायला लागले आहे. संस्कार देणे किंवा ते मनावर बिंबवणे म्हणजे काही खायचे काम नाही किंवा कुठला शॉर्ट टर्म कोर्स नाही तर संस्कारीत होणे हा एक साधनेचा भाग आहे. ह्यात संस्कार करणारा जर सुसंस्कारित नसेल तर मग सगळंच अवघड आहे.

विवाह संस्कार म्हणजेच विवाह किंवा लग्न. विवाह म्हटला कि दोन व्यक्ती, दोन कुटुंब आलीत. त्यासाठी सर्वसाधारणपणे तो मुलगा असो किंवा मुलगी ह्यांच्या मनावर सर्व संस्कार बिंबविताना त्यांना प्रत्येक संस्काराचे महत्व सांगायला हवे. आई आणि वडील ह्यामध्ये आईची भूमिका जास्त जवळची मानली जाते कारण मुलगा असो किंवा मुलगी हि आईच्या सानिध्यात जास्त असते. आपले अपत्य हळूहळू मोठे होत असताना त्याच्यातली समज, त्याचे विचार, त्याच्यात होणारे बदल त्यावर वेळीच दुरुस्ती पालकच करू शकतात त्यासाठी वेगळ्या संस्कार वर्गाला जाण्याची गरज नसते. शैक्षणिक वय पार पाडत असताना पाल्याला कदाचित समाजाचे व्यवहार कळत नसतील तरी त्याची स्वत:ची एक भूमिका ठरलेली असते आणि त्यात पालकांचा विशेष वाटा असतो. एकदा का शैक्षणिक सत्र पूर्ण करून पाल्याने आयुष्याच्या वाटेवर मार्गक्रमण करीत असताना लागलेले धक्के, टोणपे खात्ताना पालकांनी केलेल्या संस्काराची शिदोरी त्याच्या कामी येते आणि तीच त्याला त्यातून सहीसलामत बाहेर काढते.

पूर्वी लग्न हे मुलगा आणि मुलगी ह्यांच्या पत्रिका, त्यांची घराणी, त्यांचे स्थैर्य आणि समाजातील स्थान हे बघून करण्यात येत आणि त्यात बहुतांशी म्हणजे ९५% लग्न आणि त्यांचे संसार देखील निर्विघ्न होत असे. परंतु २१ व्या शतकाच्या पूर्वाधात मुलामुलींची लग्न हि एक मोठी समस्या पुढे येऊन उभी राहिली आहे.  आता एकमेकांचे घराणे बघण्यापेक्षा एकमेकाचे पॅकेज बघून लग्न ठरविली जातात.  पत्रिका बघून लग्न करणे ह्याला थोतांड म्हटल्या जाते. एरवी ज्योतिष्याकडे हात पसरून भविष्य जाणून घेणारी मंडळी पत्रिका बघायची म्हटल्यास नाक मुरडायला लागली आहेत. एवढेच नाही तर प्रेमविवाह टिकत नाहीत का ? किंवा इतर धर्मात आणि समाजात काय पत्रिका बघून लग्न करतात का ? त्यांची टिकत नाही का ? ह्यावर भले मोठे लेक्चर दिल्या जाते. वास्तविकता फार भयाण आहे. इतक्यात वधूवर सूचक मंडळे चांगलीच फोफावली आहेत. वधू वर सूचक मंडळाची एक जाहिरात होती त्याचे शीर्षक होते “आमच्याकडची लग्ने टिकतात”.

आजकाल ठामपणे कुठले लग्न टिकेल हे कुणीच सांगू शकत नाही. न्यायालयात अगदीच तकलादू किंवा फालतू कारणांनी घटस्फोटाची प्रकरणे दाखल होऊ लागली आहेत आणि त्याचा न्यायनिवाडा करणे हे देखील न्यायालयाची डोकेदुखी झाली आहे. सध्या सोशल मिडिया मुळे आणि असंगती संग दोषेन ह्या कारणांनी देखील घटस्फोटाचे प्रमाण पराकोटीचे वाढले आहे. ह्यावर उपाययोजना काय ते भलेभल्यांना माहित नाही. एकंदरीत काय तर सगळाच आनंदीआनंद आहे.

आपल्या समाजात मोबाईल, सोशल मिडिया आणि टीव्ही मालिका हे साधारण २०१० पासून प्रकर्षाने वाढले. त्यानंतर इतक्या प्रकारचे मोबाईल ऍपस आलेत कि केवळ बोटांच्या हालचालीवर होत्याचे नव्हते व्हायला वेळ लागत नाही. ह्यात भर पडली अनाहूत सल्लेगारांची. हिंदू धर्मात विवाह किंवा लग्न हे जन्मोजन्मीचे नाते आहे असे नमूद केले आहे तरी पण घटस्फोटीतांची संख्या आश्चर्यचकित करणारी आहे. गेल्या २५ वर्षाच्या काळात घटस्फोटाची प्रकरणे ऐकून आणि वाचून त्यातील कारणे थक्क करणारी आहेत. आताशा न्यायालयाने देखील त्यांच्या न्यायनिवाड्यात कायद्याचा गैरवापर आणि त्याची दखल घेण्यास सुरुवात केली आहे. सोशल मिडिया आणि टीव्ही मालिका वर आजकाल सर्रास अश्या गोष्टी दाखविल्या जात आहेत त्या जोडप्यांच्या विवादात खतपाणी घालण्याचे काम करीत आहे. ह्यातून वेळीच सावध झाले नाहीत तर लग्न संस्था कोलमडून पडायला वेळ लागणार नाही आणि असे झाले तर त्याचे वैयक्तिक, आर्थिक, सामाजिक आणि राष्ट्रीय नुकसान निश्चित आहे.

प्रत्येकाने थोडासा विचार केला तर ह्या सर्व गोष्टीचा उलगडा होऊ शकतो. अगदी सुरुवातीपासूनच विचार करायला हवा. इच्छा असेल तर त्यातून मार्ग हा नक्कीच सापडणार.  प्रत्येक आईवडिलांनी हा विचार आवर्जून करावा जेणेकरून त्यांची पुढील पिढी हि त्यांच्या संसाराच्या जबाबदाऱ्यांची जाणीव ठेवतील आणि यशस्वीरित्या पार पाडतील.  प्रत्येक आईवडिलांनी त्यांचे पाल्य मग तो मुलगा असो किंवा मुलगी यांच्यासोबत तार्किक संवाद ठेवणे अत्यंत आवश्यक आहे, काय बरोबर काय चूक हे वेळीच सांगणे अत्यंत गरजेचे आहे. लग्नसंबंधात सहवास, विश्वास आणि आदर ह्या तीन बाबी अत्यंत महत्वाच्या आहेत. लग्नाच्या वयापर्यंत जर मुलगा किंवा मुलगी यांना त्यांच्या पालकांकडून ह्या तीन बाबींवर बाळकडू दिले गेले नाहीत तर तो मुलगा किंवा मुलगी हे लग्न करण्यास मुळात तयारच नाही असे म्हणायला हवे. मुलगा किंवा मुलगी जेव्हा मोठे होत असतात तेव्हा ते सभोवतालच्या घडणाऱ्या गोष्टींचे निरीक्षण करतात आणि त्या नुसार काय चूक आणि काय बरोबर हे त्यांच्या मनावर बिंबवले जाते. त्यामुळे पालकांची जबाबदारी खूप मोठी आहे, त्यांनी जे बरोबर आहे त्याचेच उदाहरण आपल्या पाल्यासमोर ठेवावयास हवे. पालकांनी आपल्या पाल्यांमध्ये मग दोन मुली असो किंवा एक मुलगा एक मुलगी असो किंवा दोन्ही मुले असोत, कधीही भेदभाव किंवा तुलना करू नये. एक आवडता एक नावडता हि संकल्पना फार खोलवर मनावर रुजते. पर्यायाने त्यांची लग्ने झाल्यावर हा भेदभाव किंवा तुलना हि प्रकर्षाने जोपासल्या जाते. मग एक सून लाडकी आणि दुसरी सून दोडकी होते, एक जावई खूप लाडाचा आणि दुसरा जावई बिनकामाचा होतो. अशी तुलना किंवा भेदभाव केल्यास दुरावा वाढत जातो आणि त्याचे रुपांतर रोजच्या कटकटीमध्ये होते. प्रत्येक आईवडील आपल्या मुलांना सारखेच प्रेम करतात त्यांचे सारखे लाड करतात पण अभावितपणे तुलना किंवा भेदभाव अजाणतेपणी होऊन जातो त्याची सल कायम दर्शनी भागात राहते.

आजकाल शेअरिंगचे आणि स्पेस देण्याचे फॅड खूप वाढले आहे. महाविद्यालयात सहशिक्षण असल्यामुळे साहजिक प्रत्येकाला मित्र मैत्रिणी असतात. मग जे पालकांसोबत संवाद करू शकत नाही ते पर्यायाने आपल्या मित्र मैत्रिणी सोबत शेअरिंग करतात. ह्यात त्यांना एक कळत नाही कि ज्या गोष्टी आपण प्रामुख्याने टाळायला हव्या त्याच गोष्टी मित्र किंवा मैत्रिणीला सांगितल्या जातात. मग ह्यातून गुपिते तयार होतात आणि लग्न झाल्यानंतर ह्या गुपितांचे ओझे वाढते. लग्न ठरल्यानंतर आणि होण्यापूर्वी काही इच्छुक जोडपे संवादात इतके जास्त मश्गुल असतात कि नको त्या गोष्टी ते शेअरिंग करतात आणि एकदा का लग्न झाले कि मग त्यांच्यात बोलण्यासारखे काहीच उरत नाही मग गाठीशी असलेल्या माहितीवरून एकमेकांची उणीदुणी काढली जातात आणि वाद विकोपाला पोहोचतात.

एवढ्यावरच हे थांबत नाही, तर लग्न झाल्यावर मुलगा आणि मुलगी म्हणजे नवरा आणि बायको एकमेकांसोबत संवाद कमी पण इतरांशी संवाद जास्ती करायला लागतात ज्यामुळे काय होते ज्या गोष्टी दोघात राहायला हव्या त्या सगळ्या मित्र मैत्रिणींना, नातेवाईकांना कळतात आणि हे लोक अगदीच दबा धरून बसलेलेच असतात मग तेल ओतून भडका उडविण्याचे सोप्पे काम बाकी असते ते देखील अनायसे पूर्णत्वास जाते.

असले शेअरिंग करताना ह्या जोडप्याला एक कळत नाही कि ते आपल्या मित्रमैत्रिणींना किंवा नातेवाईकांना किंवा आपल्या आईवडिलांना नको त्या गोष्टी सांगून आपल्याच नात्यातली आणि आपल्याच घरातली फट दुसऱ्याला दाखवत आहोत आणि अशी फट दिसल्यावर त्याचे भगदाड पडायला फार काळ लागत नाही. बरे शेअरिंग करताना एक लक्षात येते कि माझा नवरा, माझी बायको, माझा दीर, माझी नणंद, माझी सासू, माझा सासरा कसे आहेत त्याचे वैशिष्ट्यपूर्ण वर्णन सांगितल्या जाते मग दुसरी ऐकणारी बाजू देखील कमी थोडीच असते, ती देखील शांत करण्याऐवजी आपल्या वकुबाने त्यात तेल ओतण्याचे काम करते.  एक प्रामुख्याने लक्षात येते कि असे सल्लेगार कधीही आपल्या घरातला अंधार त्या चर्चेत कधीच आणीत नाही परंतु सल्ला देताना पाणी टाकण्याऐवजी ती आग कशी भडकेल यावर जास्त जोर देत असतात. पर्यायाने आपल्याच घरावर वरवंटा फिरविण्याचे काम केले जाते आणि सरतेशेवटी हातात काहीच उरत नाही. असले शेअरिंग करण्यापेक्षा ज्याच्या सोबत तक्रार आहे त्याचेसोबतच सुसंवाद साधून चर्चेतून मार्ग काढावा, परंतु ज्यांचा आपल्या संसारात दुरान्वयाने संबंध नसतो अश्या मित्र मैत्रिणी, आईवडिल आणि नातेवाईकांसोबत असे घरातले विषय शेअरिंग करून स्वत:च्याच पायावर धोंडा मारून घेण्याचे काम केल्या जाते.

विवाहित जोडप्याच्या संसारिक आयुष्यात कुणाच्याही पालकांचा आणि मित्र मैत्रिणींचा हस्तक्षेप नसावा. तसेच विवाहित जोडप्याने देखील अगदीच आवश्यक असल्यास आईवडिलांना विश्वासात घेऊन गोष्टी शेअर कराव्या. परंतु असे लक्षात येते कि दिवस उजाडला कि मावळेपर्यंत मोबाईल घेऊन घरातल्या प्रत्येक गोष्टी आईवडिलांना आणि मित्र मैत्रिणींना शेअर केल्या जातात आणि एक सहानुभूती मिळविण्याचा आटापिटा केल्या जातो, त्यातून साध्य काहीच होत नाही उलटपक्षी विवाहित जोडप्यात दुरावा निर्माण करण्याचे कार्य निरंतर होत राहते.

विवाहित जोडप्यांमध्ये आजकाल तुलना करण्याचे प्रमाण वाढलेले आहे. आईवडिलांनी अजाणतेपणी केलेला भेदभाव आणि मित्रमैत्रिणीचे आर्थिक स्थान ह्यावर तुलना करून सगळा रोष विवाहित जोडपे एकमेकांवर काढतात, वास्तविक त्यांना जाणीव नसते कि प्रत्येक व्यक्ती हा ज्याच्या त्याच्या प्रारब्धाने आपली ओंजळी भरून घेत असतो. प्रत्येकाच्या दिव्याखाली अंधार असतो, प्रत्येकाच्या डोक्यावर प्रापंचिक जबाबदाऱ्या असतातच परंतु ते त्याचा कधीच बभ्रा करीत नाही तर शांतपणे विचार करून त्यातून यशस्वीपणे घोडदौड करीत असतात. काहींना वाटते कि आपल्या पार्टनरला खूप मोठ्ठा पैसा मिळाला पाहिजे, खूप मोठ्ठे घर असले पाहिजे, खूप कमीत कमी जबाबदारी असायला हव्या, आपला पार्टनर आपल्या मुठीत असला पाहिजे, उठ म्हटलं कि उठ आणि बस म्हटलं कि बसला पाहिजे. निश्चितच चांगले विचार आहेत, पण खूप पैसा मिळाला कि जबाबदारी वाढते आणि मग घरातला वेळ हा प्रामुख्याने ऑफिसमध्ये द्यावा लागतो ह्याची जाणीव विचार करताना होत नाही. खूप मोठ्ठे घर असावे हे प्रत्येकाचे स्वप्न असतेच ते असायला पण पाहिजे पण त्यासाठी आधी आपण कश्या घरातून आलो याचे देखील भान विचार करताना असायला हवे.

एका पिढीतून दुसऱ्या पिढीला जो विचारांचा बटवा द्यायला हवा तो नेमका मिळत नाही आणि भौतिकदृष्ट्या सर्व विचार करून संसाराची गाडी अधोगतीला चालली आहे हे नक्की. अँपल कंपनीचा मालक आणि नंतरचा सी.ई.ओ. स्टीव जॉब्स हा कर्करोगाने वयाच्या ५५ व्या वर्षी अकस्मात गेला.  त्याला जेव्हा कळले कि त्याला स्वादुपिंडाच्या असाध्य अश्या कर्करोगाने ग्रासले आहे तेव्हा त्याला जाणीव झाली, तो म्हणाला कि मृत्यू हा जीवनाचा एकच सर्वोत्तम शोध आहे. जर तुम्ही प्रत्येक दिवस तुमचा शेवटचा दिवस असल्यासारखे जगलात, तर तुम्ही नक्कीच बरोबर असता. रोज सकाळी उठल्यावर आरश्यात बघा आणि स्वत:ला विचार कि आज माझ्या आयुष्यातील शेवटचा दिवस असता तर मी जे करणार आहे ते मला करायचे आहे   का ? आज ते करू का ? असा विचार केला कि अनेक विचार आणि कृतीची निरुपयोगीता लक्षात येते. भलत्याच गोष्टींना महत्व देणे, पैसा, वास्तू आणि वस्तू यांचा संग्रह करणे व मानापमान या गोष्टींच्या मागे वेळ घालविण्याची निरर्थकता कळते. आपल्या नात्यांचे आणि त्यांना वेळ देण्याचे महत्व जाणवू लागते. मृत्यू हे आपल्या सर्वांचे गंतव्य स्थान आहे. त्यातून कोणीही सुटलेले नाही. तेव्हा सगळ्यांशी चांगले वागावे, उगीच कुणाला दुखवू नये, स्वत:ला श्रेष्ठ व दुसऱ्याला कमी लेखू नये. तुमचा वेळ मर्यादित आहे, त्यामुळे दुसऱ्याचे जीवन जगण्यात वेळ वाया घालवू नका. म्हणजे देखाव्यासाठी दुसऱ्याची नक्कल करण्याचा प्रयत्न करण्यात वेळ घालवू नका, इतरांच्या मतांच्या गोंगाटात तुमचा स्वत:चा आवाज बुडू देऊ नका. 

स्टीव जॉब्स चे ध्येय पैसा कमावणे हेच होते, पण त्याने कबुल केले कि जेव्हा त्याने खूप पैसा कमविला तेव्हा त्याच्या लक्षात आले कि, आयुष्यात खूप पैसा कमाविल्यामुळे वैयक्तिक गरजा ह्यात काहीच फरक पडला नाही, जेवढी जागा आधी लागायची तेवढीच नंतर देखील लागायची, आहार देखील तेवढाच राहिला पण ह्या हव्यासापोटी मानसिक शांती भंग झाली.

आज वैवाहिक जीवनात मन:शांती हीच महत्वाची आहे. ती मिळविण्यासाठी दोघांनी शांतपणे विचार करायला हवा, एकमेकांना पुरेसे समजून घ्यायला हवे, एकमेकांना सहवास द्यायला हवा, एकमेकांचा आदर करायला हवा, एकमेकाच्या कर्तुत्वावर विश्वास ठेवायला हवा, पत्रिकेत गुण जुळतात म्हणून लग्न टिकत नाही तर ते टिकतात आपल्या जोडीदाराच्या गुणांना गोंजारून आणि अवगुणांना दुर्लक्षित करून. स्वत:चा संसार हा विचारपूर्वक आणि एकमेकांवरच्या विश्वासाने आणि आदराने यशस्वी करावा. इतरांच्या अनुभवातून त्यांनी केलेल्या चुका प्रामुख्याने आपल्या संसारात वर्ज्य करून स्वत:च्या संसाराचा गाढा ओढावा, दुसऱ्यांच्या अनुभवावरून स्वत:चे जीवन जगणे प्रामुख्याने टाळावे मग संसारातली गोडी चाखण्याची मजा काही औरच आहे ह्याचा आनंद घेता येईल.

माझे बाबा

 माझे बाबा,  

हरिहर भाऊराव अलोणी ३०.३.१९३३ ला अत्यंत गरीब कुटुंबात जन्म झाला, पाटणसावंगी, सावनेर अश्या त्याकाळच्या खेड्यात एकत्र कुटुंबात आयुष्याची सुरुवात होत असताना वयाच्या अजाणत्या वयात आईचे छत्र हरवले. १९५३ मध्ये नागपूरला मध्य रेल्वे मध्ये मालगाडी गार्ड या पदावर रुजू झाले, त्यावेळी आतेभावाच्या मुलांची शिक्षणं आणि स्वतःची नोकरी सांभाळत मजल दरमजल करीत अक्षरशः हलाखीचे दिवस बघितले. गार्डच्या नोकरी मध्ये पण अत्यंत खडतर प्रवास, आमला-बल्लारशहा-नागपूर अशी शिफ्ट ड्युटी. घरातल्या सर्व जबाबदाऱ्या पार पाडत असताना १९६८ मध्ये लग्न झाले. माझी आई कुसुम नरसिंह पोतदार ची सौ स्नेहलता हरिहर अलोणी झाली. आई पण शिक्षिका त्यामुळे दोघांनी आमच्या एकत्र कुटुंबाचे सर्व सणवार सांभाळत सगळ्या घरावर संस्कार केले. माझा जन्म १९७१ मध्ये झाला, काहीच दिवसात आम्ही झेंडा चौक महालला राहायला आलो, तिथूनच माझे शालेय शिक्षण सुरू झाले, त्याकाळातच माझ्या बाबांची नागपूर डीआरएम कार्यालयात बदली झाली आणि ऑपरेटिंग डिपार्टमेंट मधून सेवानिवृत्त झाले. 

जेव्हापासून मला कळायला लागले तेव्हापासून मी त्यांच्या नजरेत भेदकता आणि आवाजात करारीपणा  अनुभवला. साधारणत: आमच्या अलोणी कुटुंबातले जवळपास सगळेच टरकून असायचे. माझे सख्खेचुलत भाऊ सतीश, संजय, मिलिंद, नितीन, बहीण लता आणि हर्षा यांनी माझ्यासोबत कित्येकदा बाबांच्या शिस्तीचा धाक अनुभवला. सगळ्यांना त्यांच्या बद्दल एक आदरयुक्त भीती ही असायचीच. मी तर कायम त्यांच्या धाकातच वाढलो, प्रसंगी मार हि खाल्ला, पण माझे कोडकौतुक करताना त्यांनी त्याही परिस्थितीत कधीही हाथ आखडता घेतला नाही. मला कायम आठवते की दोन आकडी पगार असताना देखील केवळ मला कबूल केले होते म्हणून मला स्कॉलरशिप मिळाली तेव्हा माझ्यासाठी खास मुंबईवरून तीन आकडी किमतीचा कॅरमबोर्ड आणून दिला. आमच्या महालच्या घरात एकत्र कुटुंबाचे सगळे सण म्हणजे आम्हा सगळ्यांना पर्वणी असायची. माझे सख्खेचूलत, मामेभाऊ आणि बहिणी, प्रशांत, राहुल, रवी, दीपाली आणि मीनल ह्यांचे सोबत दिवाळीचे फटाके आणि फराळ अगदी सगळ्या वेळी माझे बाबा भक्कमपणे आमच्या सगळ्यांच्या मागे असायचे. 

एक एक रूपया जमवून माझ्या आईबाबांनी सुरेंद्रनगरला प्लॉट घेतला आणि त्यावर घर बांधले. नाव पण अगदी समर्पक “विसावा” अगदी नावाप्रमाणे सगळ्यांना विसाव्याचे स्थानच जणू. माझे शालेय शिक्षण पूर्ण करून आम्ही नवीन घरी राहायला आलो. माझे पदवी शिक्षण पूर्ण होतानाच आईबाबा दोघेही सेवानिवृत्त झाले होते. माझ्या आयुष्यात माझे आईबाबा अगदी ढाल आणि तलवार सारखेच होते, प्रसंगानुरूप दोघेही आपली भूमिका घ्यायचे आणि कधी अदलाबदल करायचे, कधीही आणि कुठेही मला कमी पडू दिले नाही. वेळच्या वेळी सायकल, मग पुढे स्कुटर आणि कार घेताना कधीही मागेपुढे पाहिले नाही. मध्य रेल्वेच्या नोकरीत असल्याने पास मिळायचा आणि मग कित्येकदा मुंबईची ट्रिप व्हायचीच. मुंबईला माझे आजोबा तीर्थस्वरूप हरदास काकांकडे हक्काने मुक्कामी राहून संपूर्ण मुंबई दर्शन करायचे हा नेहमीचा नियम होता. हरदास काकांच्या महासागर गणेश मंदिरात आरतीला नेमाने हजर राहणे हा मुंबई वास्तव्यात नित्यनियम राहायचा. तिथून बदलापूर ला दत्तुमामा कडे आणि नरहरी भाऊ कडे जायचेच. 

सेवानिवृत्त झाल्यावर सर्वप्रथम माझे बाबा आमच्या सेंट्रल रेल्वे को-ऑप हौसिंग सोसायटीचे सचिव म्हणून निवडून आले. तीन वर्षे संपूर्ण सचोटीने सोसायटीचा कारभार केला. त्यादरम्यान मी विज्ञानाची पदवी पूर्ण केली. त्यावेळी नोकरी करण्यापेक्षा अजून शिकून घे म्हणून मला विधी महाविद्यालयात टाकले आणि विधी पदवी पूर्ण केली त्यात पण त्यांचाच पुढाकार. १९९९ ला माझे लग्न झाले, माझ्या लग्नात देखील रात्री वरात ते ही बँड आणि बग्गी मध्ये काढून सुनेचा गृहप्रवेश थाटात केला, स्वागत समारंभ अगदी धडाक्यात केला, कल्याणी सहचारिणी झाली आणि तिच्यासोबत संसार सुरू झाला. कल्याणीला पण घरात त्यांचा दरारा अनुभवायला मिळाला. कदाचित काही मनासारख्या गोष्टी करता आल्या नसतील पण तिचा तिने कधी बभ्रा केला नाही, हा हि तिच्या त्यांच्यापोटी आदरभाव असणार. काहीच वर्षात मी दिवाणी न्यायाधीश म्हणून चंद्रपूर ला नोकरीला लागलो तेव्हा त्यांच्या चेहऱ्यावरचा आनंद, तेज आणि एक अभिमान मी बघितला आहे. वयाच्या ३० व्या वर्षापर्यंत आईबाबांच्या छत्राखाली राहणारा मुलगा पहिल्यांदा घराबाहेर नोकरीनिमित्त निघताना त्यांच्या भावनांवर ताबा ठेवून मला मारलेली मिठी ही अजून जाणवते. मला बसवर सोडायला आले तेव्हा त्यांच्या मनातली चलबिचल मला कधीही जाणवू दिली नाही. २००२ मध्ये अनयचा जन्म झाला तेव्हा आजोबा-आजी नातवाच्या दंग्यात आणि कौतुकात समरस व्हायचे. तेव्हा मला जाणवायचे की ज्या गोष्टी माझ्यासाठी वर्ज्य होत्या त्याबाबत अनयला मुभा होती, अनयचे कोडकौतुक व्हायचे आणि मला आईबाबांमधला बदल जाणवायला लागला. माझ्या दोन्ही भावजया नेहमीच म्हणायच्या “बाबाकाका तुम्ही आता खूप बदलले आता नातू इतका मस्ती करतो पण तुम्ही एकदाही त्याला समज देत नाही”.

चंद्रपूर,  वरोरा आणि साकोली येथे माझ्या वास्तव्यात आईबाबा माझ्या सोबत अधूनमधून राहायला यायचे. आपला मुलगा न्यायाधीशाच्या खुर्चीत कसा दिसतो हे बघायला माझे आईबाबा आवर्जून चंद्रपूर, वरोरा आणि साकोली ला आले. त्यांनी कायम माझ्यासोबत राहावे ही माझी इच्छा असताना देखील माझ्या संसाराला त्यांनी नेहमीच मोकळेपण दिले. कल्याणीने प्रत्येक सणाला नागपूरला यायचे अशी त्यांची इच्छा कायम असायची आणि कल्याणीने पण त्या इच्छेचा मान कायम राखला. २००६ ला मी नागपूरला बदलीवर आलो पण माझ्या आईसोबत राहण्याची इच्छा केवळ तीन महिनेपर्यंतच राहिली. १९ सप्टेंबर २००६ ला आईचे अचानक निघून जाणे सगळ्यांना लागले होते. सहचारिणीचे असे अवकाळी निघून जाणे माझ्या बाबांना खूप जिव्हारी लागले त्याही परिस्थितीत माझे बाबा माझ्या आणि कल्याणीच्या मागे भक्कमपणे उभे राहिले. २००८ मध्ये अद्वयचा जन्म झाला तेव्हा त्यांना आभाळ ठेंगणे झाले होते. अनय आणि अद्वय चे सगळे वाढदिवस आणि त्यांच्या मुंजी पण थाटात केल्या. अनयची आणि अद्वयची मुंज अगदी धुमधडाक्यात केली त्यांच्याही वरातीत फेर धरून नाचताना त्यांना बघताना उर भरून यायचा. त्यांच्याच पठडीत तयार होताना मला माझ्यातले वेगळेपण जाणवत होते. त्यांचा सहस्त्रचंद्रयाग केला तेव्हा ५ ही सुनांनी त्यांना ८० निरंजनांनी ओवाळले तेव्हा त्यांचे डोळे पाणावले होते संपूर्णतेचा एक भाव त्यांच्या मुखावर होता.  

मे २००९ मध्ये माझ्या बदलीचे दिवस होते, परंतु मला बदलीच्या जागी जाण्यात स्वारस्य उरले नव्हते, बाबा कायम माझा उत्कर्षसाठी काहीही त्याग करायला तयार होते पण त्यांचा नागपूरचा मित्रपरिवार नातेवाईक सोडून माझ्यासोबत बदलीच्या नोकरीत महाराष्ट्र दर्शन करायला तयार होईनात. ते नेहमी म्हणायचे, "मी एका टेबलवर चार प्रमोशन्स घेतली आता कुठे तुझ्या मागे मागे फिरू".  एक मुलगा आणि एक न्यायिक अधिकारी यांच्यातले द्वंद्वयुद्ध शेवटी सुदैवाने एका मुलाने जिंकले. माझा नोकरी सोडण्याचा निर्णय त्यांना कधी रुजलाच नाही. त्यानंतर वकिली सुरू केल्यावर पहिल्या केस मध्ये माझ्या विरुद्ध निर्णय लागल्याचा त्यांना खूप राग आणि अतीव दुःख झाले होते. आपल्या मुलाने अपयश बघूच नये हा कायम अट्टाहास त्यांचा राहिला. महतप्रयासाने शेवटी अनय आणि अद्वय यांच्या शिक्षणाचा पाया मजबूत होण्यासाठी त्यांनी माझ्या निर्णयाला अनिच्छेने का असो दुजोरा दिला. माझ्या निर्णयामुळे आज दोघेही मुले छान शाळा कॉलेजात शिक्षण घेत आहे याचे त्यांना मनस्वी कौतुक होते. 

कल्याणीने जरी त्यांच्या निग्रहाचा अनुभव घेतला असला तरी आईबाबांनी तिचे सगळे सणवार, कोडकौतुक अगदी उत्साहाने आणि आनंदाने साजरे केले याची पण जाणीव तिला आहे. कल्याणीने देखील माझी आई गेल्यावर आमच्या कुटुंबाचा डोलारा अगदी मनाने, आनंदाने आणि जिद्दीने सांभाळला.  मला माझ्या बाबांचे प्रेम हळूहळू उलगडत गेले. मग ते सतीशला बँकेत नोकरी लागल्याचा आनंद असो, किंवा संजयने जम्बो झेरॉक्सचे दुकान टाकल्याचे कौतुक असो, मिलिंदला कुटुंबातील पहिला इंजिनियर झाल्याचे असो किंवा नितीनला बँकेत नोकरी लागण्याचे असो. हेच माझे बाबा जेव्हा लताच्या लग्नात वरातीला धाय मोकलून रडताना बघितले तेव्हा समजत नसताना देखील माझ्या मनात कालवाकालव झाली होती. या सर्वांना त्यांचे बाबाकाका कायम लक्ष्यात राहतील. 

कुणाचेही लग्न समारंभ असो किंवा वैकुंठगमन असो कायम माझे बाबा हिरीरीने समोर असायचे, त्यांनीच मला शेवटच्या अंत्यविधी क्रिया कश्या कराव्यात हे शिकवले. सेवानिवृत्त क्लब मध्ये आपल्या सहकाऱ्यांना मदत करणे, सामाजिक कामात लक्ष देणे, सचोटीने वागणे ह्याचे बाळकडू नेहमीच मला मिळत गेले.  त्यांनी कधी तोंडभरून कौतुक करताना जरी नाही दाखवले तरी त्यांची प्रेम करण्याची पद्धत वेगळी होती. त्यांनी मुलांसाठी आणि कल्याणीसाठी केलेली बचत एव्हाना फळे देण्यास सुरू झाली आहे. कल्याणीला निक्षून सांगायचे मुलांसाठी साठवलेले पैसे कधीही खर्च करायचे नाही.

संजयच्या अचानक जाण्याने त्यांना झालेला विलक्षण त्रास मी बघितला होता. माझ्या कोविडच्या जीवघेण्या आजारात जेवढी कल्याणी खंबीरपणे उभी राहिली तेवढेच माझे बाबा देखील ठामपणे माझ्या मागे उभे होते.  संजय गेल्यानंतर ओंकार इंजिनिअर झाला आणि नोकरीला लागला हे पाहून त्यांना भावनाविवश होताना आम्ही बघितले. अमय आणि अथर्व दोघांनी इंजिनीअर कॉलेज मध्ये अडमिशन घेतल्याचे त्यांना विशेष कौतुक होते. त्यांना आमच्या पूर्णेशचे लग्न बघायचे होते त्यासाठी तर इतके उत्साहित होते की त्याच दरम्यान घरात छोटासा अपघात झाल्यावर देखील पूर्णेशच्या लग्नाचा धोशा कायम असायचा. शेवटी लग्नाला कसेबसे हजर झाले. अनघा आणि संपदाचे लग्न हे त्यांच्या यादीतले पुढचे कार्य होते.

गेल्या वर्षात माझे बाबा पुष्कळसे खचले होते, खुप भावनिक झाले होते, थोड्याश्या गोष्टींवरून, जुन्या आठवणींवरून लगेच भावुक व्हायचे. कायम आईच्या फोटोकडे बघत राहायचे. माझे पुढे कसे होईल याची कायम त्यांना चिंता असायची. अगदी पद्धतशीररित्या हळूहळू त्यांनी बँकेचे, पोस्टाचे व्यवहार मला आवर्जून शिकवले जणू काही त्यांना चाहूल लागली होती. कल्याणीने सून असून देखील अगदी मुलीला लाजवेल इतकी त्यांची शुश्रूषा केली. आई २००६ मध्ये गेल्यानंतर कल्याणीने एकटीने सगळ्यांचा सांभाळ कुठलीही तक्रार न करता अगदी नेटाने केला. असे माझे बाबा, आमच्याकडे बघताना त्यांना कितीतरी वेळा भावनाविवश होऊन रडताना मी बघितले आहे. अखेर ७ तारखेला नियतीने घाला घातला, ९० वर्षाचे थकलेले शरीर कुठलीही व्याधी नसताना ईश्वरचरणी लीन झाले. जाण्यापूर्वी त्यांनी माझ्याकडे टाकलेला कटाक्ष  आणि हळूवार मिटलेले डोळे बघून मला अजूनही आतून पिळवटून टाकतं. त्यांच्या अंत्यविधीच्या वेळी मी कित्येक नातेवाईकांना बोलताना ऐकले की बाबाकाकांचा काय दरारा होता. सगळ्यांचे बाबाकाका गेले आणि एक पर्व संपलं. आईबाबांच्या या सर्व आठवणी कायम सोबत राहतील. वयाचे ९० वर्ष एक अजातशत्रू व्यक्तिमत्व,  संपूर्ण निरोगी आयुष्य ते ज्या धडाडीने जगले त्या जगण्याला माझा सलाम...

त्यांच्याच पावलांवर चालण्याचा माझा कायम प्रयत्न असेल हीच माझी त्यांना भावपूर्ण श्रद्धांजली...

न मातुः परदैवतम्

नान्नोदकसमं दानं तिथिर्नैकादशी समा।

न मातुः परदैवतम्॥ 

या संस्कृत श्लोकातून घेतले आहे, याचा अर्थ

धान्य आणि पाण्यापेक्षा श्रेष्ठ भिक्षा नाही; एकादशी पेक्षा श्रेष्ठ कोणताही दिवस (तिथी) नाही. गायत्री मंत्रापेक्षा श्रेष्ठ कोणताही मंत्र नाही आणि आईपेक्षा श्रेष्ठ कुठलाही देव नाही....


खरंच न मातुः परदैवतम्

आपल्या अपत्याला जन्म देताना जिचा पुनर्जन्म होतो तिच्यापेक्षा कुठलाही देव श्रेष्ठ नाहीच.. 


असंख्य त्याग आणि समर्पणाच्या भावनेतून परमेश्वराने घडवलेली आई, तिच्या कर्तुत्वाला मोल नाही, तिच्या प्रत्येक गोष्टीत प्रेम, वात्सल्य, ममत्व, करुणा.. आपल्या पिल्लाला उभं करण्यात जिच्या आयुष्याची चंदना सारखी झिज होते त्या त्यागाचे मोल नाही.. प्रसंगानुरूप कधी वार करणारी तलवार तर कधी आपल्या पिल्लाला वाचवणारी ढाल... वडिलांच्या धाकासमोर पाठीशी घालणारी प्रेमळ आई, संस्काराचे बीज मनावर रुजवणारी संयमी आई, क्षुल्लक चुकांवर पांघरूण घालणारी वात्सल्यमुर्ती आई, तर प्रसंगी डोळे वटारून पाठीत धपाटा घालणारी निग्रही आई, तर कधी आपल्या तोंडातला घास आपल्या पिल्लाला भरवणारी करुणामयी आई, जितकी तिची रूपे तेवढं तिला समजणं अवघड.. आई म्हटल्यावर व्याकरणातले सगळे संदर्भ, नियम बाजूला सारून आपलेपणा जपणारी आई, नुसतं आई म्हटल्यावर डोळ्यातून घळाघळा अश्रूंचा बांध फुटावा अश्या आईचे ऋण एकच काय जन्मोजन्मी फेडता येणार नाही.. 


आपल्या पाल्याला घडविताना जिचा प्रत्येक क्षण अन क्षण सदैव देऊनच जातो तरी तिची ओंजळ यत्किंचितही ही कमी होत नाही, तिच्यापुढे कर्णाची दानशूरता फिकी पडावी असे तिचे दातृत्च, अशी आई परमेश्वराने भरभरून घडविली आहे.. आई समजायला जन्म अपुरा पडेल, तिचे ममत्व वाचायला शब्दसंपदा कमी पडते.. मृत्यू अटळ आहे, प्रत्येकाला त्याला सामोरे जावे लागते, पण त्याच वेळी आई अगदी थोडी, जराशी कळायला लागते, तो पर्यंत उशीर झालेला असतो, प्रत्येक पाल्य स्वतः आई किंवा बाप झाल्याशिवाय आई कळतंच नाही. प्रत्येकाला देवाने बुध्दी दिली असते पण ती असून सुध्दा आई कळतंच नाही हे खरे दुर्दैव. 


आईच्या मनात हिमालयाची उतुंगता असते तसेच सागराची खोली देखील, कुठे ही सुर मारण्याचा प्रयत्न करा ना शिखर गाठता येते ना तळ.. 


उर्दू कवी मुन्नवर राणा आईवर लिहिताना म्हणतात, "मेरी ख़्वाहिश है कि मैं फिर से फ़रिश्ता हो जाऊँ माँ से इस तरह लिपट जाऊँ कि बच्चा हो जाऊँ"...खरंच ना, कितीही मोठ्ठा झालो तरी आईच्या कुशीत सर्व नकारात्मक प्रवृत्ती पासून निवांत पडून राहण्यासारखे दुसरे सुख नाही.. 


आईच्या नुसत्या आठवणीने हृदय पिळवटून जाते, सकाळच्या नितळ उन्हात ऊब देणारी आई, माध्यान्हीला शीतलता देते, तर रात्रीच्या गुलाबी थंडीत मायेने डोक्यावरून हात फिरवत सगळा क्षीण क्षणार्धात घालविते.. 


हळूहळू आई वयाने खचते तरीपण तिचे डोळे तिच्या पिल्लाला दूर आकाशात उंच भरारी घेत पाहताना आसुसलेले असतात, आयुष्यभर काबाडकष्ट करून वाढविलेल्या पिल्लाला यशस्वी बघताना डोळे पाणावलेले असतात, तिच्या मनाची झालेली झीज समजतच नाही, तिच्या वार्धक्याने आलेल्या अशक्तपणाचे आकलन होत नाही, आणि जेव्हा अंतिम सत्याला ती हसतहसत सामोरी जाते तेव्हा तिच्या आठवणींचा महापूर मनाचे गाव वाहून नेतो, पार उध्वस्त करून टाकतो. 


स्वामी तिन्ही जगाचा आईविना भिकारी, अगदी समर्पक... हे सगळं आई जेव्हा नसते तेव्हा आठवायला लागतं..

मग कायम मनात एक सल डोकावत राहते की आपल्या आप्पलपोटी स्वभावामुळे स्वतःच्या उत्कर्षाच्या काळात आईचा त्याग, तिचे समर्पण याची जरासुद्धा दखल घेण्याचे औदार्य आपल्यात नव्हते, तिने जे केले ते तिचे कर्तव्य होते अश्या खुज्या मानसिकतेचा मुखवटा आपल्या चेहऱ्यावर असतो, आपल्या कातडीचे पादत्राण जरी करून आईला घातले तरी तिच्या आईपणाची परतफेड होऊ शकणार नाही.. अशी ही आई... खरंच तिच्या पेक्षा कुठलाही देव श्रेष्ठ नाही..

WE THE PEOPLE CAN BRING THE CHANGE

Are we Nagpurians prepared for Smart City ?


Recently, our Maharashtra Government has proposed to make Nagpur as a Smart City.  This Government is accountable, within no time it has even started the work and that day is not far when our city will be a smart city.  Looking to the present scenario we must think, whether we Nagpurians are really prepared for smart city ?   The answer is simply NO.  

In progressive India everybody desires to make progress on all count, like our Maharashtra Government too, but we the people at large does not have reciprocal actions for our Government.  It is said that, A city is known from the traffic rules followed on the streets. Just look at the traffic mess, we Nagpurians created to our city.  In our society the number of persons following law is very less than breaking the laws.    Nobody desires to follow the basic traffic rules.  The red signal is there only for 90 to 120 seconds, but we dont have that much patience also.  The four wheelers are dominating the two wheelers and vice a versa.  The pedestrians are dominated by everybody including hawkers, shopkeepers and all vehicles.  The parking problem is very crucial.  Most of the four wheelers parked are actually amounts to an offence of obstacles to the traffic as per Motor Vehicles Act.   
Except the real ambulance there are thousands of ambulances in the form of two wheelers, three wheelers and four wheelers running on the streets.    Most of the pedestrians are presuming the entire road as zebra crossing, and crossing the roads as per their whims and wish. Not only pedestrians but public on vehicles are moving in the city as if they are roaming in the garden.  We must understand, for speeding the vehicles there are competitions like Motocross, even in garden there is separate provision for walking and playing.  This must be understood truly and followed scrupulously.  

Recently, Maharashtra Government through Traffic Rules and for the safety of the people, asked everybody to wear Helmet while driving two wheelers, and also asked the persons to wear a seatbelt while driving four wheelers.  To my surprise, most of the peoples and organizations started agitation on roads.

  Can we say that public safety is not important ?  Most of the organizations are creating ruckus as if the Government has committed the sin.   The Motor Vehicle Act, as amended up to date is the rule of law.  Do we require notification each time to follow these basic rules? The people always follow the rule at their home but the moment they got out of their house, God knows what happened to them. 


Unless we the people change our mindset, no matter how our Maharashtra Government desires to make this orange city as smart city, we the people will always shatter the genuine efforts of our Government.  Everybody starts taking potshots to the government but never think as to what they have contributed for the betterment of city.   

We the people have to treat the public property as if it is our own property.   In District Court also, recently urinals are reformed, but before the second wing could start working, the urinals in former wings got destroyed.  Even the urinal pipes, taps are removed by the public as if they were belonged to them.  I feel ashamed of the mindset of people.  Similar situations are visible on the streets.  Even if the Government constructs the Urinals, people cannot guarantee about their preservation for a long term. 

We have seen regular accidents on roads and most of them are out of rash and negligent driving and for not following the basic rules of traffic.  Especially, school going kids, females and veterans are falling prey to this menace of speeding.   Not only this we are loosing so many people everyday in road accidents.  Somewhere this needs to be stopped and for that, we have to change the mindset.  If we are the followers of the western culture, then we must follow their way of following the traffic rules in their respective country.   If we follow the basic rules of traffic, that itself would be called a smart city.  In this way we will complete half the work for the government.

It is my earnest request to the Government, to keep back all their genuine efforts to make our city as a smart city for some time unless the people change their mindset and guarantee to perform their duty making their contribution to the Government.  One must understand that, Ignorance of law is not excuse.   The only thing people has to do is to change their mindset, follow the basic traffic rules, assimilate a self imposed discipline, treat the public property as our own property, protect the property, guard the property.  If the people follow these basic steps, it will be a great contribution from the public to our Government in shaping up the dream of smart city.  

At present enhancement of punishment and fine is the real need of this hour.  As compared to the foreign countries the fine amount in India is very much less.  Similarly, it is also required bring the yearly renewal system for vehicles and licenses has to be suspended if the person found committing offence more than twice, so as bring some deterrence in the mind of public.

    It is my earnest request to our Government, to simply force a crackdown on the wrongdoer, enforce all the traffic rules scrupulously and make them feel what they are doing to this city. Unless these casuals are not taken to task, their mindset will not be changed at once.    While summing up, I can only say and pray, Let some wisdom be prevail upon the public, because we the people can bring the change.  So let us change our mindset and strengthen the hands of our beloved Chief Minister, in shaping this city as smart city.

SUGGESTIONS TO IMPROVE COLLEGIUM SYSTEM

At the outset, it is a welcome decision of Hon’ble Supreme Court to invite the representation and suggestions from the public who are desirous to make contribution for improving the working of Collegium System for appointment as Judges of High Courts and Supreme Court.  
The undersigned is practicing as an Advocate since 1996 in Nagpur District Court.  During the years 2001 to 2009, the undersigned had worked as a Civil Judge in Maharashtra Judiciary and after resignation resumed practice in Nagpur District Court.  While working as a Civil Judge, the undersigned was fortunate enough to closely see the working of eminent judges of Lower Judiciary as well as High Court.  But at the same time the undersigned experienced some anomalies in the judicial system and desirous to write down in the four categories as informed in the Public Notice as under :-
TRANSPARENCY

  1.       The word transparency itself means qualitative.  Mere utterance of word transparency multiple times does not tantamount to transparency but it should be seen through the action.  While having transparency the basic anomalies are required to be removed at an earliest convenience.
  2.       Equality before the law is a fundamental concept of our legal system.  All judicial officers take an oath to administer the law without fear, favour, affection or ill will.  But unfortunately it is not found so normally in the High Court. Now a days, the justice dispensation system has been converted in to justice distribution system.  The kiths and kins are practicing before them and how can a judge administer the law without favour and affection, or fear and ill will.  In such situation justice is only assured not secured.
  3.     The first and foremost suggestion to remove the discrimination amongst the judicial officers of lower judiciary and the high court.  When a Civil Judge or District Judge is appointed, he is never posted in his native place or the place where he has practiced before his selection as a Civil Judge or District Judge.
  4.        But the same rule is not followed for the Judges of High Court.  There lacks the transparency.  If the Civil Judge or District Judge is not posted at his native place or place of practice till he demits the office then same rule be applied for the Judges of High Court and Supreme Court.
  5.         Normally an Advocate practices in High Court for years together naturally and obviously gets involved with many colleagues at his bar.  Some in nice manner and some adversely.  After appointment as a Judge of High Court, he himself cannot become integrated automatically.  The slightest amount of inclination is always there with the group of lawyers he has worked with, which is translated in the favorable orders while sitting as a Judge of High Court. 
  6.    Merely becoming a Judge of High Court and Supreme Court does not tantamount that the person has a highly impeccable integrity automatically.  In order to remove the sophisticated moneyless corruption amongst the judiciary, applying the same rules to the Judge of High Court and Supreme Court as that of the Civil Judge or District Judge is a need of this hour.
  7.       For that there needs increase of at least 3 more benches of Supreme Court so that the Judge of Supreme Court whose kiths and kins are practicing in Supreme Court can be migrated to these three benches.
  8.       The benches of High Court in the state are required to be increased considering the population of the State.  In case of Judge of High Court, prior to their appointment, choice can be given to them to choose any High Court other than they have practiced, or the other bench of the parent high court if any, so that their practicing kiths and kins will not influence the justice dispensation system.



Summary of Suggestions as regards Transparency

A)   The rule which is applicable while appointing a Civil Judge or District Judge be applied mutatis mutandis while appointing a Judge of High Court or a Supreme Court.
B)     A Judge of High Court or a Supreme Court should not be appointed at his native place or the place where he has practiced.
C)   At the most a Judge can be asked to give three choices of any High Court or other bench of parent High Court other than they have practiced, so that they can be transferred on their choicest posting.
D)    There must be 3 more benches of Supreme Court.  It is the need of an hour to create more benches of Supreme Court as it is out of economic budget of the poor litigants residing at the farthest place to always reach singular Supreme Court at Delhi.
E)     The benches of High Court are required to be created considering the population of the State. 
F)     To accommodate the Judge of Supreme Court, whose kiths and kins are practicing in Supreme Court, such Judge needs to be transferred to the other benches of Supreme Court.
G)   A strict transfer policy at the time of appointment is required to be formulated so that no Judge can sit in the benches where their kiths and kins are practicing.

ELIGIBILITY

  1.        The present rule of appointing a Judge of High Court amongst the advocates practicing before High Court only has destructed the legal fabric of judicial system.  The advocates practicing before High Court only deals with constitutional matters and writ jurisdiction and very few of them are aware about the Evidence Act and other allied laws.  It is also observed that most of them having absolutely no knowledge of the manner exhibiting documents and niceties of Evidence Act and other allied laws, which is prime concern of fact finding court.  Then such advocates after their appointment as a Judge of High Court failed to deliver justice in Appeal matters. Everywhere natural justice is not a deciding factor rather marshalling of facts and evidence is of paramount importance.  In appeal matters it requires real courage to understand the basic import of the procedural laws and substantive laws, which unfortunately does not see in some of the Advocates practicing only in High Court.  Therefore the appointments must be made amongst the advocates practicing in District Courts. 
  2.     Similarly, while appointing a Judge of High Court and Supreme Court, the practicing lawyers from the District Judiciary ought to be considered.  While considering, their candidature to test their judicial acumen their interviews may be taken instead of calling for their reports from Senior District Judges and recommendations of senior advocates.  Otherwise, the candidates will be put to extra work of polishing the District Judges and Senior Advocates for their reports and recommendations.  
  3. No push and pull theory needs to be adopted for appointment of a Judge of High Court and Supreme Court.  The Senior Advocates pushes their well wishers amongst their kiths and kins and the Judges representing the same groups prior to their appointments pulls them and places them with highest remarks before the collegiums.  This push and pull theory has ruined the life of meritorious advocates and aspirants only for the reason of not being the member of particular family or a group.
  4. The appointments of Judge of High Court and Supreme Court certainly are not a matter of lineal descendants. But it requires the    highly impeccable integrity, judicial  acumen,  judicial  balance and focus.         All these characters do not depend   upon the relatedness and close acquaintance of a sitting judge or a former   judge.     All  these  characters  can  be  found  through  the  standard questionnaire  and    the    interviews   of   each  candidate.   The  practice   of recommendations  from  a  Sitting  Judge, Senior Advocates and Senior District Judges are required to be removed from the rule book.


Summary of Suggestions as regards Eligibility

A)   The candidate or aspirant for the post of Judge of High Court or Supreme Court be considered from the District Judiciary.
B) The practice of calling reports from Senior District Judges and recommendations from Senior Advocates are to be removed from rule book.
C)   Pull and push theory of recommending the advocates of particular family and group for the post of Judge of High Court and Supreme Court required to be scrapped.
D)    Appointments of Judge of High Court and Supreme Court from the pool of lineal descendants be strictly prohibited.
E)     All candidates for the post of Judge of High Court and Supreme Court must be asked to go through standard questionnaire and the interviews.
F)     No appointments are to be made on recommendations from Senior District Judges, Senior Advocates, Minister, Governor and any person with political affiliation.   

SECRETARIAT

  1.     There must be a secretariat comprising of retired judges of Supreme Court, High Court and District Court at all the capital of the States with having main secretariat at the Centre.  This will be in aid to pick up the right candidate who can be in the zone of consideration.  They can be monitored through the local police stations in order to know their whereabouts, antecedents and personal character.
  2.         This secretariat will be completely independent of executives, bureaucrats and be made accountable for the information and database of the aspirants for the post of Judge of High Court and Supreme Court.
  3.          The secretariat will only collect the information and handover to the collegiums and will not have any power to pick up or discard any candidature as per their whims and wishes.


Summary of suggestions as regards SECRETARIAT

A)   Secretariat shall be strictly comprising of retired judges of Supreme Court, High Court and District Court at every state capital and the main at the Centre.
B) Secretariat shall be completely independent of executives and bureaucrats.
C)   Secretariat shall have no power to allow or discard the candidature of any aspirant.

COMPLAINTS

  1.       No anonymous and frivolous complaint needs to be entertained.  Due to the groups amongst the advocates there are chances of complaints out of personal vendetta and requires to be rejected out rightly.  Only complaints with names and signature supported with material evidence should be considered.
  2.      The complaints are required to be filed before the secretariat and upon the receipt of the complaint; work of concerned Judge or aspirant requires to be stopped till the preliminary investigations are completed.
  3.           The complaints at the Secretariat level requires to be completed within 15 days and report be sent to the concerned Chief Justice of High Court who will take the decision within 30 days from the date of its receipt upon the report received and the opportunity to the concerned aspirant to explain.

  • C)   Time frame of resolving the complaints needs to be fixed.


MISCELLANEOUS

  1.           The transfer policy for the judges of High Court and Supreme Court be made     applicable to the existing sitting judges. 
  2.          There  should  not  be  any  interference  of   political  families,   parties while      appointing the judges.
  3.       Recommendation by anybody itself creates the way of hobnobbing which  leads to money or moneyless corruption or corruption in barter form i.e. giving relief or to give bashing to advocates representing particular groups or particular families.
  4. The  retired   Judge  of High Court and Supreme Court be posted in Secretariat and  not  in  the  Tribunals and other constitutional machinery as it will increase the  influence  in  pre-retirement  judgments  for  the post-retirement posts and benefits.
  5. Instead the Judges who could not make it to the post of a Judge of High Court and Supreme Court can be appointed in the Tribunal and Other constitutional machinery.

Summary of suggestions as regards MISCELLANEOUS
  • A)  Transfer policy must be made applicable to existing sitting judges at an earliest convenience.
  • B)     No interference of persons of political affiliation
  • C)   Recommendations strictly prohibited.
  • D)    No re-appointments of Judge of High Court and Supreme Court on Tribunals and Other Constitutional Machinery.
  • E)     Appointments to Tribunals and Other Constitutional Machinery shall be strictly from the judges who could not make out to the post of a Judge of High Court or Supreme Court.


Recently the Supreme Court has declined the NJAC for the reasons mentioned in the judgment.  Therefore it is incumbent to strengthen the Collegium System and the same can be strengthened only on the rigid policies and strict implementation.  The reasons for declining the NJAC should not be allowed to enter in the Collegiums System by ways of recommendations, undue approaches by political parties, senior advocates and senior district judges.
